Piretti Real Estate Office Policy
PIRETTI REAL ESTATE was begun in May of 1978 by Peter and
Mary Jo Piretti to service the real estate needs of the local community
and to introduce the area to those interested in making the Berkshires
their home. Always aware of the uniqueness of our area, we
take pride in our knowledge of the local market and all that our
community has to offer. Our purpose is to assist buyers and
sellers in the purchase or sale of a home in an honest and forthright
manner. We believe that honesty and integrity are of primary
importance in our relationship with our clients, customers and colleagues
and to that end we offer the following explanation of the Agency
relationship that exists when doing business with Realtors in this
office:
- Seller's Agent:
when listing a property for sale, Piretti Real
Estate and its associates represent the seller. The agent
owes the seller undivided loyalty, reasonable care, disclosure,
obedience to lawful instruction, confidentiality and accountability,
provided, however, that the agent must disclose known material
defects in the real estate. The agent must put the sellers’ interests
first and negotiate for the best price and terms for their client,
the seller. An “Agency Disclosure” form must
be signed prior to listing a home for sale with a Seller.
- Sub-Agent: Piretti
Real Estate does not act as a sub-agent when viewing other agencies
listing, but rather acts as a buyer’s agent. They
also do not offer compensation to sub-agents who are working with
buyer-customers to view Piretti Real Estate listings, due to the
potential for “vicarious liability” for the seller
(both Seller and Seller’s Agent are liable for the acts of
the sub-agent with regard to their transaction when sub-agency
is allowed).
- Buyer-Agents: Buyers working
with Realtors of this office will be represented as “buyer-clients” and
their best interests will be our prime objective, unless viewing
properties that are listed with this office. In which case,
the following type of agency will apply, with permission of all
parties:
Disclosed Dual Agency: It is the preference of Piretti
Real Estate to represent only one party in a transaction. Our intent
is to act as a single agent because it is very difficult to represent
both the Seller and the Buyer without a conflict of interest. However,
there are situations which arise that could create a dual agency
relationship (such as when we act as a buyer agent and show a property
that has been listed by this office). If such a situation should
occur during the marketing of your property or the showing of property
as a Buyer-Agent to a buyer client, we will disclose it to all parties,
discuss the situation and then at that time have all parties to the
transaction acknowledge and assent to our role as a disclosed dual
agent. All this will be done with written permission and full
knowledge of what role Piretti Real Estate will play if we act as
a dual agent: under a dual agency relationship, the agent limits
his/her fiduciary duties by not disclosing ay confidential information
or by advocating for either party to the detriment of the other party
in the transaction. When listing a buyer or seller, disclosure
is made to them that company policy is one of disclosed dual agency
should the buyer decide to purchase a seller client’s property. At
the time of the listing, a “consent to dual agency” shall
be signed, in case the situation should arise. When dual agency
does occur, all parties are required to sign an additional form, “notice
of dual agency”.
Limited Agency, Non-Agency and Transactional Brokerage are
not commonly practiced by this office but may be reviewed on a case
by case basis.
Fee Structure: It
is the belief of Piretti Real Estate that it is in our clients’ best interests to cooperate fully and
compensate equally buyers’ agents or facilitators, with
the permission of the seller. When Piretti Real
Estate acts as an agent of the buyer, they will similarly attempt
to have the fee come from the proceeds of the sale, with the
permission of the seller and the listing agent. However,
if this is not possible, the buyer will be responsible for
the fee due their agent.
Our goal is to find the perfect match of buyer to home
and make the transition a smooth one for all concerned. We strive
to treat all of our clients with professionalism so that the purchase
or sale of their home will be a positive experience.
This office is a member of the National and
Massachusetts Association of Realtors as well as the Berkshire County Board
of Realtors and its Multiple Listing Service which provides access to all
properties in the County that are listed with the service and affords sellers
the opportunity to expose their home to over 500 Realtors locally. We also list our properties
on Realtor.com and Pirettirealestate.com, exposing the property to
the entire internet community…an excellent marketing approach.
Mary Jo Piretti Miller
Mary Jo Piretti Miller is the Broker/Owner of PIRETTI REAL ESTATE,
a graduate of Lenox Memorial High School and a 1971 graduate of the
College of New Rochelle with a Bachelor of Arts Degree. She is
a member of the Massachusetts and National Associations of Realtors
and a past member of both Boards of Directors. She completed
advance educational requirements for the designation GRI (Graduate,
Realtors Institute) in 1993. Mary Jo was chosen as the Berkshire
County “Realtor of the Year” for 1997. In addition
to her activities in the local and State Associations, she is an active
member of the community and served as the President of the Lenox Library
Board of Managers from 1999-2002 and is a member of its 150th Anniversary
Fundraising Committee, a member of the Lenox Chamber of Commerce, the
Central Berkshire Chamber of Commerce, a Director of Legacy Banks and
a member of its Credit-ALCO Committee, a member of the Legacy Banks’ Charitable
Foundation, former member of the St. Ann’s Parish Council for
six years and past President of the Lenox Elementary Parent Teachers’ Organization. She
is the mother of three children: Hannah, a social worker and
counselor of children and adolescents (and mother of Charlie Josephine),
Luke, a Chiropractor in Boston and Conner a graduate of Boston College,
now living in Denver and working in property management. She
is married to Leonard A. Miller, a retired teacher in the Berkshire
Hills Regional School system, owner of Sports School Day Camp and father
of Leonard, Jr., Cathleen and Shane, and grandfather of Tyne, Sam,
Claire and Ben.
Dave Sefcik
Dave Sefcik is a life long resident of Berkshire County having lived
in Williamstown for thirty four years and Lenox for the past twenty five
years. A graduate of McCann Tech in North Adams, Dave holds an associate’s
degree in computer science from Berkshire Community College and is a
Navy veteran. Before launching a career in Real Estate, Dave built a
career in Information Systems working for four Berkshire businesses,
the last of which was KB Toys for thirty years. At KB Dave held the position
of Director of Store Systems and Network Services. Dave’s community
activities include ten years as the Finance Officer for the Williamstown
Post 152 American Legion; two terms with the Lenox School Committee;
past President of the Southern Berkshire Educational Collaborative; and
twelve years of teaching religious education with St. Ann’s parish
in Lenox. Dave is a serious amateur photographer and is a past president
of the Berkshire Museum Camera Club. Dave and his wife Nancy, a second
grade teacher in Lenox, have two grown daughters; Emily of Adams, MA
and Hilary of Shrewsbury, MA.; two grandchildren and two step grandchildren.
